Welcome to AgentNovus. This Privacy Policy explains how The Lead Standard ("we," "us," or "our") collects, uses, discloses, and protects information in connection with our Software as a Service (SaaS) platform, AgentNovus (the "Service").

Our Service is a Customer Relationship Management (CRM) platform designed for and provided to U.S.-based health insurance agents ("Agents," "you," or "our Customers"). This policy covers two categories of personal information:

Agent Data: Information we collect directly from our Agents when they sign up for and use the Service.

Agent's Client Data: Information that our Agents upload, store, and manage on our platform about their clients and leads.

The Lead Standard is a marketing and technology company. We are not an insurance company, broker, or agent, and we do not provide insurance or financial advice.

By using our Service, you agree to the collection and use of information in accordance with this policy.

Information We Collect

a. Information We Collect Directly from Agents (Agent Data)

When you, as an Agent, register for an AgentNovus account, we collect personal information directly from you, which may include:

Identity Information: Full Name, Email Address, Phone Number.

Business Information: Business or Agency Name.

Payment Information: We use a third-party payment processor (e.g., Stripe) to handle subscription payments. We do not directly collect or store your full credit card or bank account information on our servers. Our payment processor may collect payment information directly from you on our behalf.

b. Information Our Agents Collect and Store on Our Platform (Agent's Client Data)

As a CRM platform, AgentNovus processes and stores personal information that our Agents upload or input into the Service about their clients and leads ("Agent's Client Data"). We act as a service provider or data processor for our Agents with respect to this data. The Agent is the data controller and is responsible for ensuring they have the legal right and necessary consent to collect and process this information.

Agent's Client Data stored on our platform may include, but is not limited to:

Full Name, Address, Phone Number, Email Address

Date of Birth

Income information and other financial details necessary for Affordable Care Act (ACA) applications.

Notes related to health insurance status, needs, and history.

We do not control this data and only process it as directed by the Agent through their use of our Service.

c. Information We Collect Automatically

When you visit our marketing website (https://agentnovus.com) or use our Service, we may collect certain information automatically from your device, including:

Usage Data: Your IP address, browser type, operating system, referral URLs, pages viewed, and the dates/times of your visits.

Cookies and Tracking Technologies: We use cookies, web beacons, and tracking pixels to analyze trends, administer the website, track users' movements around the site, and to gather demographic information. This is primarily for analytics and advertising purposes related to marketing our Service to other potential Agents.

How We Use Information

a. Use of Agent Data

We use the information we collect directly from our Agents for the following purposes:

To Provide and Maintain the Service: To create and manage your account, provide customer support, and ensure the platform's functionality.

To Process Transactions: To process your subscription payments for the Service.

To Communicate With You: To send you service-related announcements, updates, security alerts, and administrative messages.

For Marketing and Advertising: To send you emails and other communications about new features, products, services, and promotional offers that we believe may be of interest to you as an Agent. You may opt out of receiving marketing communications at any time.

To Improve Our Service: To monitor and analyze usage patterns, trends, and activities in connection with our Service to improve its design and functionality.

b. Use of Agent's Client Data

Our use of Agent's Client Data is strictly limited to providing, maintaining, and improving the Service for our Agents.

We will never use Agent's Client Data for our own marketing, advertising, or any other purpose not directly related to the provision of the AgentNovus platform to the Agent who controls the data.

How We Share and Disclose Information

We do not sell or rent your personal information. We may share information in the following circumstances:

With Third-Party Service Providers: We share information with third-party vendors and service providers who perform services on our behalf. These include:

Payment Processors: To process your subscription payments (e.g., Stripe).

Cloud Hosting Providers: To host our platform and store data (e.g., Amazon Web Services).

Communication Services: To deliver emails and SMS messages to our Agents (e.g., Twilio). These service providers are contractually obligated to protect your data and are prohibited from using it for any other purpose.

To Comply with the Law: We may disclose information if required to do so by law or in the good faith belief that such action is necessary to comply with a legal obligation, protect and defend our rights or property, or protect the safety of our users or the public.

Business Transfers: In the event of a merger, acquisition, financing, or sale of all or a portion of our assets, information may be transferred as part of that transaction.

Data Security

We implement reasonable administrative, technical, and physical security measures to protect the information we process from unauthorized access, disclosure, alteration, or destruction. However, no method of transmission over the Internet or method of electronic storage is 100% secure. Therefore, we cannot guarantee its absolute security.

Data Retention

We retain Agent Data for as long as you have an active account with us and for a reasonable period thereafter to comply with our legal and operational obligations.

We retain Agent's Client Data on behalf of our Agents for as long as the Agent instructs us to, typically for as long as their account is active. Agents are responsible for managing the data they store on our platform, including its deletion.

Your Data Privacy Choices and Rights

You have certain rights regarding the personal information we hold about you.

Account Information: You may update or correct your Agent Data at any time by logging into your account settings.

Marketing Communications: You can opt out of receiving promotional emails from us by following the unsubscribe link included in those emails.

For California Residents (California Consumer Privacy Act - CCPA):

If you are a California resident, you have the following rights:

Right to Know: You have the right to request information about the categories and specific pieces of personal information we have collected about you, as well as the sources of such information, the purpose for collecting it, and the categories of third parties with whom we share it.

Right to Delete: You have the right to request the deletion of your personal information that we have collected from you, subject to certain exceptions.

Right to Opt-Out: We do not "sell" personal information as the term is traditionally understood. However, to the extent that our use of third-party analytics or advertising cookies constitutes a "sale" under the CCPA's broad definition, you may have the right to opt-out.
