Welcome to AgentNovus. These Terms of Service ("Terms") govern your use of the AgentNovus customer relationship management (CRM) software and services (collectively, the "Service") provided by The Lead Standard ("Company," "we," "us," or "our").
By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Service.
Description of Service:
AgentNovus is a CRM platform designed to provide insurance agents with tools for lead generation, marketing automation, client communication, and pipeline management. The Service includes access to our software platform, pre-built marketing funnels, website templates, and automated communication sequences.
The Lead Standard is a marketing and technology company providing the AgentNovus software. The Lead Standard is not an insurance company, carrier, or brokerage and does not provide insurance advice.
User Accounts and Responsibilities
Account Creation: To use the Service, you must register for an account and provide accurate, complete information. You are responsible for maintaining the confidentiality of your account password.
User Conduct: You agree to use the Service in compliance with all applicable laws and regulations, including but not limited to, the Telephone Consumer Protection Act (TCPA), CAN-SPAM Act, and all relevant insurance industry regulations.
Prohibited Use: You may not use the Service to send unsolicited marketing messages (spam), harass others, or engage in any unlawful or fraudulent activity. You are solely responsible for the content you create and distribute through the Service.
Subscription, Payments, and Billing
Trial Periods: We may offer a trial subscription for the Service (e.g., a 14-day, $1 trial). At the end of the trial period, your subscription will automatically convert to a paid monthly or yearly plan unless you cancel prior to the end of the trial period.
Subscription Fees: You will be billed in advance on a recurring, periodic basis (either monthly or annually), depending on the subscription plan you select. All fees are non-refundable except as required by law.
Payment Information: You agree to provide and maintain a valid payment method. By submitting such payment information, you authorize us to charge all subscription fees incurred through your account to any such payment instruments.
Price Changes: The Lead Standard reserves the right to modify the subscription fees at any time. We will provide you with reasonable prior notice of any change in subscription fees to give you an opportunity to terminate your subscription before such change becomes effective.
Cancellation and Termination
You may cancel your subscription at any time through your account billing portal. The cancellation will take effect at the end of the current billing cycle. Upon termination, your right to use the Service will cease immediately, and we may permanently delete your account and all the data associated with it.
We reserve the right to suspend or terminate your account immediately, without prior notice or liability, for any reason, including without limitation if you breach these Terms.
Intellectual Property
The Service and its original content (excluding content provided by users), features, and functionality are and will remain the exclusive property of The Lead Standard. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of The Lead Standard.
By using the Service, we grant you a limited, non-exclusive, non-transferable license to use our provided templates, funnels, and marketing sequences for the sole purpose of operating your business through the AgentNovus platform.
Disclaimer of Warranties
The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
Limitation of Liability
In no event shall The Lead Standard, nor its directors, employees, partners, or agents, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.
Governing Law
These Terms shall be governed and construed in accordance with the laws of the State of [Your State, e.g., Florida], United States, without regard to its conflict of law provisions.
Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide at least 30 days' notice prior to any new terms taking effect. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
